The purpose of the privacy policy is to inform individuals, customers, users of products or services, collaborators, employees, and other persons (hereinafter: the “individual”) cooperating with KANARDIA d.o.o. (hereinafter: the “company”) about the purposes, legal bases, security measures, and rights of individuals regarding the processing of personal data carried out by the company.
We value your privacy and therefore always protect your data carefully.
We process personal data in accordance with the applicable personal data protection legislation and other legislation that provides us with a legal basis for the processing of personal data.

1) Personal Data
Personal data means any information relating to an identified or identifiable individual; an identifiable individual is one who can be identified, directly or indirectly, in particular by reference to an identifier such as: a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that individual.
2) Purposes of Processing and Legal Bases for Data Processing
The company collects and processes personal data on the following legal bases:
-
processing is necessary for compliance with a legal obligation to which the controller is subject;
-
processing is necessary for the performance of a contract to which the individual to whom the personal data relates is a contracting party, or in order to take steps at the request of such individual prior to entering into a contract;
-
processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party;
-
the individual to whom the personal data relates has consented to the processing of their personal data for one or more specific purposes;
-
processing is necessary in order to protect the vital interests of the individual to whom the personal data relates or of another natural person.
2.1) Performance of a Concluded Contract
In cases where an individual enters into a contract with the company, such contract represents the legal basis for the processing of personal data. The company may therefore process personal data for the purpose of concluding and performing the contract, such as the sale of goods and services, preparation of offers, participation in various programs among others. If the individual does not provide personal data, the company cannot conclude the contract, nor can the company perform the service or deliver goods or other products in accordance with the concluded contract, as it does not possess the necessary data for performance. On this basis, the company processes only and exclusively those personal data that are necessary for the conclusion and proper performance of contractual obligations.
The legal basis for data processing is the contract. The retention period is until the purpose of the contract has been fulfilled or up to 6 years after the termination of the contract, except in cases where a dispute related to the contract arises between the individual and the company. In such case, the company retains the data for an additional 10 years after the final court decision, arbitration, or court settlement, or, if no judicial dispute occurred, 6 years from the date of amicable settlement of the dispute.
2.2) Legitimate Interest
The company may also process personal data on the basis of the legitimate interest pursued by the company. This is not permitted where such interests are overridden by the interests or fundamental rights and freedoms of the individual to whom the personal data relates, which require protection of personal data. In the event of the use of legitimate interest, the company shall carry out an assessment in accordance with the legislation. The processing of personal data of individuals for direct marketing purposes shall be deemed to be carried out under legitimate interest.
The company may process personal data of individuals collected from publicly accessible sources or within the framework of the lawful performance of activities also for the purposes of offering goods, services, employment, informing about benefits, events among others. To achieve these purposes, the company may use regular mail, telephone calls, electronic mail, and other telecommunication means. For direct marketing purposes, the company may process the following personal data of individuals: first and last name of the individual, permanent or temporary residence address, telephone number, and e-mail address. The company may process the aforementioned personal data for direct marketing purposes even without the explicit consent of the individual. The individual may at any time request the termination of such communication and processing of personal data and revoke the receipt of messages through the unsubscribe link in the received message or submit a request by e-mail or regular mail to the company’s address.
2.3) Processing Based on Consent
If the company does not have a legal basis established on the basis of law, contractual obligation, legitimate interest, or protection of the life of the individual, it may request the individual’s consent. The company may therefore process certain personal data of the individual also for the following purposes when the individual provides consent for this:

residence address and e-mail address (for the purposes of notification and communication);

photographs, video recordings, and other content relating to the individual (e.g. publication of images of individuals on the website for the purposes of documenting activities and informing the public about the work and events of the company);
-
other purposes for which the individual agrees by giving consent.
If the individual gives consent for the processing of personal data and at some point no longer wishes this, they may request the termination of the processing of personal data by submitting a request by e-mail or regular mail to the company’s address. Withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal. Upon receipt of the withdrawal or request for deletion, the data shall be deleted no later than within 15 days. The company may also delete such data before withdrawal when the purpose of the processing of personal data has been achieved or if so required by law.
Exceptionally, the company may refuse a request for deletion for reasons set out in the General Data Protection Regulation (GDPR) in cases involving the exercise of the right to freedom of expression and information, compliance with a legal obligation of processing, reasons of public interest in the area of public health, archiving purposes in the public interest, scientific or historical research purposes, statistical purposes, or the establishment, exercise, or defence of legal claims.
The legal basis for data processing is consent. The data shall be processed until revocation or withdrawal of consent or until the purpose of processing has been fulfilled. Withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal.
2.4) Protection of the Vital Interests of the Individual
The company may process personal data of the individual to whom the personal data relates if this is necessary in order to protect their vital interests. In urgent cases, the company may search for the individual’s identity document, verify whether that person exists in its database, review their medical history, or establish contact with their relatives, for which the company does not require the individual’s consent. The above applies in cases where this is urgently necessary in order to protect the vital interests of the individual.
3) Retention and Deletion of Personal Data
The company shall retain personal data only for as long as necessary to achieve the purpose for which the personal data was collected and processed. If the company processes data on the basis of law, it shall retain such data for the period prescribed by law. In this regard, certain data is retained during the period of cooperation with the company, while some data must be retained permanently. Personal data processed by the company on the basis of a contractual relationship with the individual shall be retained for the period necessary for the performance of the contract and for an additional 6 years after its termination, except in cases where a dispute related to the contract arises between the individual and the company. In such case, the company shall retain the data for an additional 10 years after the final court decision, arbitration, or court settlement, or, if no judicial dispute occurred, 6 years from the date of amicable settlement of the dispute. Personal data processed by the company on the basis of the individual’s personal consent or legitimate interest shall be retained until the withdrawal of consent or until a request for deletion of the data. Upon receipt of the withdrawal or request for deletion, the data shall be deleted without undue delay. The company may also delete such data before withdrawal when the purpose of the processing of personal data has been achieved or if so required by law. In the event of the exercise of the rights of the individual, the company shall retain the personal data of such individual until the matter has been finally resolved, and after final resolution in accordance with the final decision in the matter.
Exceptionally, the company may refuse a request for deletion for reasons such as: the exercise of the right to freedom of expression and information, compliance with a legal obligation of processing, reasons of public interest in the area of public health, archiving purposes in the public interest, scientific or historical research purposes, statistical purposes, or the establishment, exercise, or defence of legal claims. Upon expiry of the retention period, the company must effectively and permanently delete or anonymize the personal data so that it can no longer be associated with a specific individual.
4) Contractual Processing of Personal Data and Data Transfer
The company may entrust individual personal data processing activities to a contractual processor on the basis of a data processing agreement. Contractual processors may process the entrusted data exclusively on behalf of the controller, within the limits of the authorization set out in a written contract or other legal act, and in accordance with the purposes defined in this privacy policy.
The contractual processors with whom the company cooperates is primarily:

For the purposes of better overview and supervision of contractual processors and proper regulation of the contractual relationship, the company also maintains a list of contractual processors, which includes all specific contractual processors with whom the company cooperates.
Under no circumstances shall the company disclose an individual’s personal data to unauthorized third parties. Contractual processors may process personal data solely within the scope of the company’s instructions and may not use personal data for any other purposes.
The company, as controller, and its employees do not transfer personal data to third countries (outside the member states of the European Economic Area – EU member states as well as Iceland, Norway, and Liechtenstein) or to international organizations, whereby relationships with contractual processors are governed on the basis of standard contractual clauses (standard contracts adopted by the European Commission) and/or binding corporate rules (adopted by the company and approved by supervisory authorities in the EU).
5) Cookies
The company’s website does not operate by means of so-called cookies.
6) Data Security and Accuracy of Data
The company ensures information security and infrastructure security (premises and application-system software).
Among other things, our information systems are protected by antivirus programs and a firewall. We have implemented appropriate organizational and technical security measures intended to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access, and against other unlawful and unauthorized forms of processing. In the event of transmitting special categories of personal data, such data is transmitted in encrypted form and protected by password. The individual is solely responsible for ensuring that their personal data is transmitted securely and that the transmitted data is accurate and up to date.
7) Rights of the Individual Regarding Data Processing
The individual to whom the personal data relates has the right to request access to personal data and rectification or deletion of personal data or restriction of processing concerning them, as well as the right to object to processing and the right to data portability. The individual’s request shall be handled in accordance with the provisions of the General Data Protection Regulation (GDPR) and the applicable personal data protection legislation.
All of the above rights and any questions may be exercised by the individual by submitting a request to the company’s address. The company shall respond to the individual’s request without undue delay and no later than one month after receipt of the request. Taking into account the complexity and number of requests, this period may be extended by a maximum of two additional months, of which the individual shall be informed together with the reasons for the delay. The exercise of rights is free of charge for the individual; however, the company may charge a reasonable fee if the request is manifestly unfounded or excessive, in particular because it is repetitive. In such case, the company may also refuse the request. In the event of doubt regarding the identity of the individual, additional information necessary for establishing identity may be requested.
In its decision regarding the individual’s request, the company shall also inform the individual of the reasons for the decision and information regarding the right to lodge a complaint with the supervisory authority within 15 days from being informed of the decision. The right to lodge a complaint with the supervisory authority may be exercised by the individual with: the Information Commissioner of the Republic of Slovenia at the address: Dunajska 22, 1000 Ljubljana (e-mail: gp.ip@ip-rs.si, website: www.ip-rs.si).

Namen politike zasebnosti je seznaniti posameznike, stranke, uporabnike izdelkov ali storitev, sodelavce, zaposlene ter druge osebe (v nadaljevanju: »posameznik«), ki sodelujejo s podjetjem KANARDIA d.o.o. (v nadaljevanju: »podjetje«), o namenih, pravnih podlagah, varnostnih ukrepih in pravicah posameznikov glede obdelave osebnih podatkov, ki jih izvaja podjetje.

Osebne podatke obdelujemo v skladu z veljavno zakonodajo s področja varstva osebnih podatkov in drugo zakonodajo, ki nam daje pravno podlago za obdelavo osebnih podatkov.

1) Osebni podatki
Osebni podatek pomeni katero koli informacijo v zvezi z določenim ali določljivim posameznikom; določljivi posameznik je tisti, ki ga je mogoče neposredno ali posredno določiti, zlasti z navedbo identifikatorja, kot so: ime, identifikacijska številka, podatki o lokaciji, spletni identifikator ali navedba enega ali več dejavnikov, ki so značilni za fizično, fiziološko, genetsko, duševno, gospodarsko, kulturno ali družbeno identiteto tega posameznika.
2) Nameni obdelave in podlage za obdelavo podatkov
Podjetje zbira in obdeluje osebne podatke na naslednjih pravnih podlagah:
-
obdelava je potrebna za izpolnitev zakonske obveznosti, ki velja za upravljavca;
-
obdelava je potrebna za izvajanje pogodbe, katere pogodbena stranka je posameznik, na katerega se nanašajo osebni podatki, ali za izvajanje ukrepov na zahtevo takega posameznika pred sklenitvijo pogodbe;
-
obdelava je potrebna zaradi zakonitih interesov, za katere si prizadeva upravljavec ali tretja oseba;
-
posameznik, na katerega se nanašajo osebni podatki, je privolil v obdelavo svojih osebnih podatkov v enega ali več določenih namenov;
-
obdelava je potrebna za zaščito življenjskih interesov posameznika, na katerega se nanašajo osebni podatki, ali druge fizične osebe.
2.1) Izvajanje sklenjene pogodbe
V primerih, ko posameznik s podjetjem sklene pogodbo, ta predstavlja pravno podlago za obdelavo osebnih podatkov. Osebne podatke sme podjetje tako obdelovati za sklenitev in izvajanje pogodbe, kot je npr. prodaja blaga in storitev, priprava ponudbe, sodelovanje v različnih programih ipd. Če posameznik osebnih podatkov ne posreduje, podjetje ne more skleniti pogodbe, prav tako podjetje ne more izvesti storitve oziroma dostaviti blaga ali drugih produktov v skladu s sklenjeno pogodbo, saj nima potrebnih podatkov za izvedbo. Na tej podlagi podjetje obdeluje samo in izključno tiste osebne podatke, ki so potrebni za sklenitev in pravilno izvajanje pogodbenih obveznosti.
Pravna podlaga za obdelavo podatkov je pogodba. Rok hrambe je do izpolnitve namena pogodbe oz. do 6 let po prenehanju pogodbe, razen v primerih, ko pride med posameznikom in podjetjem do spora v zvezi s pogodbo. V takem primeru hrani podjetje podatke še 10 let po pravnomočnosti sodne odločbe, arbitraže ali sodne poravnave ali, če sodnega spora ni bilo, 6 let od dneva mirne razrešitve spora.
2.2) Zakoniti interes
Podjetje lahko osebne podatke obdeluje tudi na podlagi zakonitega interesa, za katerega si prizadeva. Slednje ni dopustno, kadar nad takimi interesi prevladajo interesi ali temeljne pravice in svoboščine posameznika, na katerega se nanašajo osebni podatki, ki zahtevajo varstvo osebnih podatkov. V primeru uporabe zakonitega interesa podjetje opravi presojo skladno z zakonodajo. Obdelava osebnih podatkov posameznikov za namene neposrednega trženja se šteje za opravljeno v zakonitem interesu.
Podjetje lahko obdeluje osebne podatke posameznikov, ki jih je zbralo iz javno dostopnih virov ali v okviru zakonitega opravljanja dejavnosti, tudi za namene ponujanja blaga, storitev, zaposlitev, obveščanja o ugodnostih, dogodkih ipd. Za dosego teh namenov lahko podjetje uporablja navadno pošto, telefonske klice, elektronsko pošto in druga telekomunikacijska sredstva. Za namene neposrednega trženja lahko podjetje obdeluje naslednje osebne podatke posameznikov: ime in priimek posameznika, naslov stalnega ali začasnega prebivališča, telefonsko številko in naslov elektronske pošte. Navedene osebne podatke lahko za namene neposrednega trženja podjetje obdeluje tudi brez izrecne privolitve posameznika. Posameznik lahko kadarkoli zahteva prekinitev tovrstnega komuniciranja in obdelave osebnih podatkov ter prekliče prejemanje sporočil preko povezave za odjavo v prejetem sporočilu ali posreduje zahtevek po elektronski pošti ali z redno pošto na naslov podjetja.
2.3) Obdelava na podlagi privolitve oz. soglasja
Če podjetje nima pravne podlage izkazane na osnovi zakona, pogodbene obveznosti, zakonitega interesa ali zaščite življenja posameznika, sme posameznika zaprositi za privolitev oz. soglasje. Tako lahko obdeluje določene osebne podatke posameznika tudi za naslednje namene, kadar posameznik poda za to soglasje:
-
naslov prebivališča in naslov elektronske pošte (za namene obveščanja in komunikacije);
-
fotografije, videoposnetki in druge vsebine, ki se nanašajo na posameznika (npr. objava slik posameznikov na spletni strani za namene dokumentiranja aktivnosti in obveščanja javnosti o delu in dogodkih podjetja;
-
druge namene, za katere se posameznik strinja s privolitvijo.
Če posameznik poda soglasje za obdelavo osebnih podatkov in v nekem trenutku tega več ne želi, lahko zahteva prekinitev obdelave osebnih podatkov z zahtevkom po elektronski pošti ali z redno pošto na naslov podjetja. Preklic privolitve ne vpliva na zakonitost obdelave na podlagi privolitve pred njenim preklicem. Po prejemu preklica ali zahteve za izbris se podatki izbrišejo najkasneje v 15 dneh. Podjetje lahko te podatke izbriše tudi pred preklicem, kadar je bil dosežen namen obdelave osebnih podatkov ali če tako določa zakon.
Izjemoma lahko podjetje zavrne zahtevo za izbris iz razlogov iz Splošne uredbe v primerih uresničevanja pravice do svobode izražanja in obveščanja, izpolnjevanja pravne obveznosti obdelave, razlogov javnega interesa na področju javnega zdravja, namenov arhiviranja v javnem interesu, znanstveno- ali zgodovinsko raziskovalnih namenov, statističnih namenov, izvajanja ali obrambe pravnih zahtevkov.
Pravna podlaga za obdelavo podatkov je privolitev. Podatki se bodo obdelovali do preklica oziroma do umika privolitve oziroma do izpolnitve namena obdelave. Preklic privolitve ne vpliva na zakonitost obdelave na podlagi privolitve pred njenim preklicem.
2.4) Zaščita življenjskih interesov posameznika
Podjetje lahko obdeluje osebne podatke posameznika, na katerega se nanašajo osebni podatki, v kolikor je to nujno za zaščito njegovih življenjskih interesov. V nujnih primerih lahko podjetje poišče osebni dokument posameznika, preveri, ali ta oseba obstaja v njegovi zbirki podatkov, preuči njegovo anamnezo ali naveže stik z njegovimi svojci, za kar podjetje ne potrebuje posameznikove privolitve. Navedeno velja v primeru, ko je to nujno potrebno za zaščito življenjskih interesov posameznika.
3) Hramba in izbris osebnih podatkov
Podjetje bo hranilo osebne podatke le toliko časa, dokler bo to potrebno za uresničitev namena, zaradi katerega so bili osebni podatki zbrani in obdelovani. V kolikor podjetje podatke obdeluje na podlagi zakona, jih bo hranilo za obdobje, ki ga predpisuje zakon. Pri tem se nekateri podatki hranijo v času sodelovanja s podjetjem, nekatere podatke pa je treba hraniti trajno. Osebne podatke, ki jih podjetje obdeluje na osnovi pogodbenega odnosa s posameznikom, podjetje hrani za obdobje, ki je potrebno za izvršitev pogodbe in še 6 let po njenem prenehanju, razen v primerih, ko pride med posameznikom in podjetjem do spora v zvezi s pogodbo. V takem primeru hrani podjetje podatke še 10 let po pravnomočnosti sodne odločbe, arbitraže ali sodne poravnave ali, če sodnega spora ni bilo, 6 let od dneva mirne razrešitve spora. Tiste osebne podatke, ki jih podjetje obdeluje na podlagi osebne privolite posameznika ali zakonitega interesa, bo podjetje hranilo do preklica privolitve ali do zahteve za izbris podatkov. Po prejemu preklica ali zahteve za izbris se podatki izbrišejo brez nepotrebnega odlašanja. Podjetje lahko te podatke izbriše tudi pred preklicem, kadar je bil dosežen namen obdelave osebnih podatkov ali če tako določa zakon. V primeru uveljavljanja pravic posameznika podjetje hrani osebne podatke tega posameznika, dokler o zadevi ni pravnomočno odločeno, po pravnomočnosti pa skladno s pravnomočno odločitvijo v zadevi.
Izjemoma lahko podjetje zavrne zahtevo za izbris iz razlogov, kot so: uresničevanje pravice do svobode izražanja in obveščanja, izpolnjevanje pravne obveznosti obdelave, razlogi javnega interesa na področju javnega zdravja, nameni arhiviranja v javnem interesu, znanstveno- ali zgodovinsko raziskovalni nameni ali statistični nameni, izvajanje ali obramba pravnih zahtevkov. Po preteku obdobja hrambe mora podjetje osebne podatke učinkovito in trajno izbrisati ali anonimizirati, tako da jih ni več mogoče povezati z določenim posameznikom.
4) Pogodbena obdelava osebnih podatkov in iznos podatkov
Podjetje lahko posamezne obdelave osebnih podatkov na osnovi pogodbe o pogodbeni obdelavi zaupa pogodbenemu obdelovalcu. Pogodbeni obdelovalci lahko zaupane podatke obdelujejo izključno v imenu upravljavca, v mejah njegovega pooblastila, ki je zapisano v pisni pogodbi oziroma drugem pravnem aktu in skladno z nameni, ki so opredeljeni v tej politiki zasebnosti.
Pogodbeni obdelovalci, s katerimi sodeluje podjetje, je predvsem:

računovodski servis
Podjetje za namene boljšega pregleda in nadzora nad pogodbenimi obdelovalci in urejenosti medsebojnega pogodbenega razmerja vodi tudi seznam pogodbenih obdelovalcev, kjer so navedeni vsi konkretni pogodbeni obdelovalci, s katerimi podjetje sodeluje.
Podjetje v nobenem primeru ne bo posredovalo osebnih podatkov posameznika tretjim nepooblaščenim osebam. Pogodbeni obdelovalci smejo osebne podatke obdelovati zgolj v okviru navodil podjetja in osebnih podatkov ne smejo uporabiti za katerekoli druge namene.
Podjetje kot upravljavec in njegovi zaposleni osebnih podatkov ne iznašajo v tretje države (izven držav članic Evropskega gospodarskega prostora – članice EU ter Islandija, Norveška in Liechtenstein) in v mednarodne organizacije, pri čemer so razmerja s pogodbenimi obdelovalci urejena na podlagi standardnih pogodbenih klavzul (tipske pogodbe, ki jih je sprejela Evropska komisija) in/ali zavezujočih poslovnih pravil (ki jih sprejme podjetje in potrdijo nadzorni organi v EU).
5) Piškotki
Spletna stran podjetja ne deluje s pomočjo t.i. piškotkov (angl. Cookies).
6) Varovanje podatkov in točnost podatkov
Podjetje skrbi za informacijsko varnost in varnost infrastrukture (prostorov in aplikativnosistemske programske opreme).
Naši informacijski sistemi so med drugim zaščiteni s protivirusnimi programi in požarnim zidom. Uvedli smo ustrezne organizacijsko-tehnične varnostne ukrepe, namenjene varstvu osebnih podatkov pred naključnim ali nezakonitim uničenjem, izgubo, spreminjanjem, nepooblaščenim razkrivanjem ali dostopom ter pred drugimi nezakonitimi in nepooblaščenimi oblikami obdelave. V primeru posredovanja posebnih vrst osebnih podatkov, jih posredujemo v šifrirani obliki in zaščitene z geslom. Posameznik je sam odgovoren, da svoje osebne podatke posreduje varno in da so posredovani podatki točni in verodostojni.
7) Pravice posameznika glede obdelave podatkov
Posameznik, na katerega se nanašajo osebni podatki, ima pravico zahtevati dostop do osebnih podatkov in popravek ali izbris osebnih podatkov ali omejitev obdelave v zvezi z njim ter pravico do ugovora obdelavi in pravico do prenosljivosti podatkov. Zahteva posameznika se obravnava skladno z določbami Splošne uredbe in veljavne zakonodaje varstva osebnih podatkov.
Vse navedene pravice in vsa vprašanja lahko posameznik uveljavlja z zahtevkom, poslanim na naslov podjetja. Na zahtevek posameznika bo podjetje odgovorilo brez nepotrebnega odlašanja, najkasneje v enem mesecu po prejemu zahteve. Ta rok se lahko ob upoštevanju kompleksnosti in števila zahtev podaljša za največ dva dodatna meseca, o čemer bo posameznik obveščen, skupaj z razlogi za zamudo. Uveljavljanje pravic je za posameznika brezplačno, vendar pa lahko podjetje zaračuna razumno plačilo, če je zahteva očitno neutemeljena ali pretirana, zlasti, če se ponavlja. V takšnem primeru lahko podjetje zahtevo tudi zavrne. V primeru dvoma o identiteti posameznika se lahko zahteva dodatne informacije, ki jih podjetje potrebuje za ugotovitev identitete.
Podjetje bo v odločitvi o zahtevi posameznika seznanilo tudi z razlogi odločitve in informacijo o pravici do pritožbe pri nadzornem organu v roku 15 dni od seznanitve z odločitvijo.
